Hello everyone!!!!
I`ve got problem and I`ll be very grateful if there is someone who can help me. I`ve got girlfriend who is Ukrainian.By the last two years we where working on the farm as students.It was legal work on students visa.This year farmer want us to come back.This should be no problem for me because Poland enjoy EU in May an broad for us will be open.unfortuntly she will be need visa and here is my problem.Has she got chance to get Visa third time if she finished study.I was searching posibilities fo her and i`ve got three ideas. 1.work permity 2.english school 3.bussines visa Maybe there is someone who can advice me what she should do to get visa.What option have the biggest chance to be aply. I will be very grateful for help and instruction Thank You |

I have included a relevant paragraph from http://www.ukvisas.gov.uk This is the UK government website listing current rules and requirements. As I read it, you must be a student aged between 18 and 25, or, if older than 25 or no longer a student, returning at the specific request of a farmer. If the same farmer wants you to return then your girlfriend would appear to be OK under these rules. You are right about the EU Entry. Germany and Austria requested that citizens of new member states not be allowed to live and work in their countries until 7 seven years after entry. The British government said they would not apply this rule (it is, IMHO, grossly unfair). Quite what this means in practise is anybody's guess - I have not seen any documentation from the UK government about this. Good luck... Ciao JG ======================================================= 18.5 - Seasonal workers in agricultural camps (Rules Paragraphs 104 -109) Purpose and operation of the scheme The scheme offers overseas nationals (mainly students) the opportunity to take up seasonal employment at certain agricultural camps in the UK without the need for work permits. Participating operators provide food and accommodation for the workers and are subject to a Home Office code of practice. The workers must be recruited under arrangements approved by the Home Office which includes a quota on the total number of seasonal workers recruited. Each UK operator participating in the scheme is allocated a certain proportion of that quota. Applicants are required to provide proof of age and status to the operator. The UK operators issue work cards to those recruited under the scheme. Applicants aged over 25 may be admitted exceptionally only at the invitation of the same farmer via the operator. A list of the UK operators currently licensed by the Home Office is given at Annex 18.1. Prior entry clearance is not mandatory for non-visa nationals Requirements for entry clearance Entry clearance as a seasonal worker at an agricultural camp may be issued if you are satisfied that the applicant: is a student in full-time education abroad, aged between 18-25 inclusive (except if returning for another season at the specific invitation of a farmer); holds a valid Home Office work card issued by an authorised operator of the scheme; intends to leave the UK at the end of the period of leave as a seasonal worker; does not intend to take employment other than through this scheme; is able to maintain and accommodate himself without resource to public funds. Home Office work card The applicant should hold a valid Home Office work card issued by one of the UK operators listed in Annex 18.1. You should check that the personal details given on the card correspond with those given on the entry clearance application form and passport. New cards with changes in colour and date are issued by the Home Office to the UK operators each year. Operators are allowed to amend and initial minor mistakes; however, other amendments, including the use of correcting fluids, are not allowed. The card records the period for which the worker is required at the farm. Workers may be transferred from the original farm to another within the scheme. Time limits Small numbers of workers are permitted to enter early in a specific year; their work cards will show the dates. Leave to enter may be given until 30 November/and applicants must intend leaving the UK at the end of this period. There is no provision for spouses and dependants to join (or accompany) a seasonal worker Entry clearance endorsements Applicants in this category should be given entry clearance endorsed ‘D: AGRICULTRAL WORKER'. Leave to enter should begin on the date the applicant is due to arrive in the UK. |
